Always confirm fees with the court before filing. Massachusetts court fees are set by the Trial Court and are subject to change. These figures reflect the 2025 fee schedule. An additional $15 Judicial Surcharge and $5 Security Fee typically apply to most filings. Fee waiver (Affidavit of Indigency) is available for qualifying parties.

Standard Surcharges Added to Most Filings

In addition to the base filing fee, most Probate & Family Court filings include a $15.00 Judicial Surcharge (M.G.L. c. 262 §4C) and a $5.00 Security Fee. These are not shown separately in the table — add $20 to most base fees listed below. 209A Protective Orders and Indigency Affidavits are exempt.
